1. Introduction

Welcome to Horizons Tour. These Terms of Service ("Terms") govern your use of our website, mobile application, and car rental services (collectively, the "Services") operated by Horizons Tour ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use our Services.

2. Eligibility

To use our Services, you must:

  • Be at least 21 years of age
  • Possess a valid driver's license that has been held for at least one year
  • Have a valid credit or debit card in your name
  • Meet our insurance and credit requirements

Additional requirements may apply for specialty or luxury vehicles. We reserve the right to refuse service to anyone at our discretion.

3. Booking and Reservations

When making a reservation through our Services:

  • You agree to provide accurate, current, and complete information
  • Reservations are subject to vehicle availability
  • We may require a deposit or pre-authorization on your payment method
  • Your reservation is confirmed only when you receive a confirmation from us
  • Rental periods are calculated on a 24-hour basis

4. Rental Agreement

Upon vehicle pickup, you will be required to sign our detailed Rental Agreement, which contains additional terms and conditions specific to your rental. The Rental Agreement, together with these Terms, constitute the entire agreement between you and Horizons Tour.

5. Fees and Payments

5.1 Rental Fees

The total cost of your rental will include:

  • Base rental rate (daily, weekly, or monthly)
  • Insurance and liability options selected
  • Optional services or equipment (GPS, baby seats, etc.)
  • Applicable taxes and fees
  • Security deposit (refundable subject to terms)

5.2 Additional Charges

You may incur additional charges for:

  • Late returns (hourly or daily charges may apply)
  • Fuel (if vehicle is not returned with the same fuel level)
  • Excess mileage beyond included allowance
  • Traffic or parking violations
  • Cleaning fees (for excessive dirt/stains/odors)
  • Damage or repair costs not covered by insurance

5.3 Payment Methods

We accept major credit cards and debit cards. The card holder must be present with the physical card at the time of vehicle pickup. Cash, checks, and prepaid cards are not accepted.

6. Cancellations and Modifications

6.1 Cancellation Policy

  • Free cancellation up to 48 hours before scheduled pickup
  • Cancellations within 48-24 hours: 50% of one day's rental fee
  • Cancellations within 24 hours: 100% of one day's rental fee
  • No-shows: 100% of the booking amount for up to 3 days

6.2 Reservation Modifications

Modifications to your reservation (dates, vehicle class, pickup location) are subject to availability and may result in price adjustments. Modifications must be made at least 24 hours before scheduled pickup.

7. Vehicle Use and Restrictions

7.1 Authorized Use

The vehicle may only be:

  • Driven by the renter or additional drivers authorized in the Rental Agreement
  • Used on properly maintained roads within the United Arab Emirates
  • Used for personal or business use (not commercial transportation)

7.2 Prohibited Use

The vehicle may not be:

  • Driven by anyone under the influence of alcohol, drugs, or medication
  • Used for any illegal purpose or to transport hazardous materials
  • Used for racing, speed testing, or driving off-road
  • Used to push or tow another vehicle
  • Driven outside the authorized geographic areas
  • Overloaded with passengers or cargo
  • Modified in any way

8. Insurance and Liability

Basic insurance coverage is included in your rental. Additional coverage options may be available at the time of booking or pickup. Your liability may be limited if you purchase optional coverage. Please refer to your Rental Agreement for specific insurance details and coverage limitations.

Insurance coverage may be void if the vehicle is used in violation of these Terms or the Rental Agreement.

9. Accidents and Damages

In the event of an accident, theft, or damage to the vehicle, you must:

  • Notify the police immediately for accidents involving injuries, property damage, or theft
  • Contact Horizons Tour at our emergency number provided in your rental documents
  • Complete an accident report form
  • Not admit fault or liability
  • Obtain names and contact information of any witnesses
  • Take photographs of the accident scene, if possible

You may be responsible for damage to the vehicle regardless of fault, subject to your insurance coverage level.

10. Vehicle Return

You agree to return the vehicle:

  • On the date and time specified in your Rental Agreement
  • To the location where it was picked up, unless otherwise arranged
  • With the same amount of fuel as at the start of the rental
  • In the same condition as received, excluding normal wear and tear
  • With all provided accessories and equipment

Late returns may result in additional charges. If you need to extend your rental, contact us before your scheduled return time.

11. Intellectual Property

All content, features, and functionality of our website and mobile application, including but not limited to text, graphics, logos, button icons, images, audio clips, data, and software, are the exclusive property of Horizons Tour and are protected by international copyright, trademark, and other intellectual property laws.

12. Limitation of Liability

To the maximum extent permitted by law, Horizons Tour shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our Services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our Services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services

13. Indemnification

You agree to defend, indemnify, and hold harmless Horizons Tour and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the courts of Dubai, UAE.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
